William Worboys, written 1813, proved 1814

This is the last Will and Testament of me William Worboys of Ashwell in the County of Hertford Farmer and Carrier First I give and devise unto my Dear Wife Elizabeth Worboys and to her Heirs and Assigns for ever All that piece or parcel of Arable Land containing by Estimation two Acres be the same more or less situate and being in Long Paintry in Quarry Field in Ashwell aforesaid purchased of the Devisees in Trust of John Hart deceased And as for and concerning all and singular the rest residue and remainder of my Messuages Cottages Lands Tenements and Hereditaments with their respective Appurtenances situate and being in the Parish of Ashwell aforesaid and in Guilden Morden in the County of Cambridge or elsewhere in the Counties of Hertford and Cambridge as well Freehold as Copyhold I give and devise the same with their and every of their Appurtenances unto my three sons William Worboys Thomas Worboys and Samuel Worboys their Heirs and Assigns for ever as Tenants in Common and not as Joint Tenants And I give and bequeath unto my said Wife all the Household Furniture Plate Linen and China which was her property before our Marriage and also all my stock in Trade of a Farmer Corn Grain Hay Cattle and Effects situate standing growing and ...ing in upon or about a certain Messuage Tenements and Farm in Ashwell aforesaid and Hinxworth in the said County of Hertford belonging to my said Wife late Beldains and now in my own Occupation, the same to be to and for her own Use and Benefit And I give and bequeath unto my said Wife Elizabeth Worboys the sum of two Hundred Pounds of lawful money of Great Britain to be paid to her within six months next after my decease And I do hereby Will and declare that the several Gifts and Devises by me hereinbefore made to or in favor of my said Wife shall be and be accepted and taken by my said Wife in bar lieu and satisfaction of such Dower and thirds at Common Law or by Custom which she might claim or be entitled to out of all or any part of my Estates ... which I at any time during the Coverture between us have or may be seised And as concerning all the residue and remainder of my Monies Securities for Money Debts to me owing Stocks Funds Goods Chattles and Personal Estate whatsoever and wheresoever and of what nature or kind soever the same be (not hereinbefore disposed of) subject to the payment of my Just Debts the aforesaid Legacy of two hundred Pounds and my Funeral and Testamentary Expences I give and bequeath the same and every part thereof unto my said three Sons William Worboys Thomas Worboys and Samuel Worboys equally to be divided between them share and share alike And I do hereby nominate and appoint Thomas Westrope of Ashwell aforesaid Farmer and my son William Worboys Executors of this my Will and the said Thomas Westrope Guardian of my Children And my Will is that my said Executors or either of them shall not be charged with or accountable for any more Monies than they respectively shall actually receive or shall come to their respective Hands under or by virtue of this my Will nor with or for any loss which shall happen to the same without their respective wilful default and that it shall and may be lawful to and for them respectively to deduct and retain all such Costs Charges and Expences as they shall sustain or be put to in the Execution of this my Will or in any wise relating thereto And I do hereby direct and declare that it shall be lawful for my said Executors and the Survivor of them and the Executors and administrators of such Survivor to pay any Debts claimed from me upon any Evidence they shall think proper to admit and to adjust settle compromise and compound all Accounts Reckonings Claims and Demands whatsoever depending between me and any other Person or Persons touching my Property Business Affairs and Concerns and to accept and take any Composition or Compositions they may think reasonable or proper for or in full of any Debts or Demands .... me And lastly I do hereby revoke and make void all former Wills and Codicils by me at any time made and do declare this to be my last Will and Testament In Witness whereof I the said William Worboys the Testator have to this my last Will and Testament contained in two Sheets of Paper set my Hand to the first Sheet and my Hand and Seal to this last Sheet thereof the fourth day of August in the Year of our Lord one thousand eight hundred and thirteen
